User Upload & Document Policy

1. Purpose

This Policy explains the rules for uploading, storing, and sharing files through this platform. It is intended to protect users, copyright holders, and the platform operator from misuse or unauthorized distribution of real-estate forms and other materials.

2. Ownership and Authorization

You may upload a document only if you own it or have written authorization to use and share it. Uploading content that belongs to others without permission may violate copyright or licensing laws. You represent and warrant that your uploads do not infringe any third-party rights.

3. Copyrighted and Restricted Materials

You must not upload copyrighted real-estate forms, including but not limited to California Association of REALTORS® (C.A.R.) forms, unless you are legally entitled to do so through your membership, brokerage, or a specific license. Blank or unlicensed templates of C.A.R. or similar forms are prohibited. The platform may remove any material suspected of violating copyright or licensing rules.

4. User Responsibility and Compliance

You retain ownership of your uploaded documents and remain fully responsible for their legality, accuracy, and current status. You must follow all applicable federal, state, and local laws, data-privacy requirements, and real-estate licensing and DRE regulations. You are responsible for ensuring compliance with your brokerage, association, or client-confidentiality policies. The platform does not verify ownership or validity of uploaded documents.

5. Limited License to the Platform

By uploading, you grant the platform a limited, non-exclusive license to store, process, and display your documents solely for purposes of app functionality and user collaboration. This license ends when you delete the document or your account, subject to backup retention required by law.

6. Data Handling and Security

Uploaded files are stored using commercially reasonable security measures. You understand that no digital system is completely secure and accept the risk of data loss, corruption, or unauthorized access. You should maintain your own copies and backups of all important files. The platform is not liable for restoring deleted or corrupted data.

7. Confidential or Personal Information

Avoid uploading sensitive personal data (e.g., Social Security numbers, financial or medical details) unless required and legally permissible. You are responsible for obtaining any necessary client consent under privacy laws such as CCPA, CPRA, or GDPR.

8. AI Processing and Automation

Uploaded materials or metadata may be processed by automated or AI-powered tools to improve search, categorization, and collaboration features. AI outputs are for informational purposes only and are not professional, legal, or financial advice. The platform does not sell or reuse user content for external AI-training or marketing purposes.

9. Malware and Prohibited Uploads

You agree not to upload files that: contain malware, viruses, or malicious code; include false, misleading, or confidential third-party data; or violate copyright, privacy, or other applicable laws. The platform may scan, block, or delete harmful files at its discretion.

10. Independent Operation Notice

This platform is independently owned and operated and is not affiliated with, sponsored by, or endorsed by the California Association of REALTORS® (C.A.R.), the California Department of Real Estate (DRE), or any other state real-estate board, agency, or association.

11. Liability Limit

To the fullest extent permitted by law, the platform, its owners, and affiliates are not liable for any damages, losses, or claims arising from user-uploaded materials. Total aggregate liability is limited to USD $100, regardless of the number or nature of claims.

12. Acceptance of Policy

By clicking “I Agree” or uploading any file, you confirm that: you have lawful rights to upload the document(s); your uploads comply with this Policy; and you accept full responsibility for their lawful use and any consequences of misuse.
